Judge pauses effort to change Kansas election mail-ballot deadline, keeping the 3-day postmark rule in place for now

A Douglas County District Court judge has temporarily blocked a 2025 change affecting how late-arriving advance mail ballots are counted, keeping Kansas’ 2017 rule in place for the moment. The order maintains the practice of counting advance mail ballots that are postmarked by Election Day but arrive at county election offices up to three days after polls close.

Judge Carl Folsom issued the temporary injunction Thursday. The court order places a hold on the 2025 law that would have altered the state’s ballot-counting timeline, pending further legal proceedings.
