Laura Kelly asks a federal judge to dismiss DOJ bid to halt Kansas in-state tuition for some students

Kansas Gov. Laura Kelly is asking a federal judge to dismiss a U.S. Department of Justice lawsuit that seeks to stop a Kansas law allowing certain students without lawful immigration status to qualify for in-state tuition at public colleges and universities. The request is set for Thursday.

According to the filing described in the report, the DOJ lawsuit was filed on June 24. The suit targets Kansas’ in-state tuition eligibility rule for that specific group of students, and it is intended to end the law as currently applied to public higher education.

The hearing on the motion to dismiss will determine whether the case can proceed, or whether the judge will throw it out at this stage.
