These Terms of Service govern your access to and use of JustKansas.com, including our website, business directory, event listings, local news, tourism content, newsletters, advertising services, account features, contact forms, listing submission forms, and related online services.

By accessing or using JustKansas.com, submitting information, creating or managing a listing, signing up for communications, purchasing advertising, or otherwise interacting with the site, you agree to these Terms. If you do not agree, do not use the site.

We may update these Terms at any time. When we do, we may post the revised Terms on this page and update the “Last Updated” date. Your continued use of the site after revised Terms are posted means you accept the revised Terms.

5. Future Business Entity

JustKansas.com may later be transferred, assigned, owned, operated, or managed by a limited liability company, corporation, nonprofit entity, partnership, successor entity, purchaser, affiliate, or other legal entity formed or selected by the owner.

If that occurs, these Terms may be assigned to that entity without additional consent from you. After assignment, references to “JustKansas,” “JustKansas.com,” “we,” “us,” or “our” may refer to that new entity. Your continued use of the site after any such update means you accept the updated owner/operator information.

6. Eligibility

You must be at least 13 years old to use JustKansas.com. If you are under the age of majority in your jurisdiction, you may use the site only with the involvement and consent of a parent or legal guardian.

The site is not directed to children under 13. Do not use the site or submit personal information if you are under 13.

By submitting information, you represent and warrant that:

You have the legal right to submit it.
The information is accurate, not misleading, and not fraudulent.
You have all required permissions, licenses, consents, and rights.
The submission does not infringe anyone’s copyright, trademark, publicity rights, privacy rights, contract rights, or other legal rights.
The submission does not contain unlawful, defamatory, harassing, discriminatory, obscene, threatening, deceptive, or harmful material.
The submission complies with all applicable laws, regulations, platform rules, advertising rules, and industry standards.

We may edit, reject, remove, reclassify, decline to publish, or delete any listing or submission for any reason, with or without notice. We do not guarantee that any listing, event, article, advertisement, or submission will be published, displayed in a particular order, indexed by search engines, receive traffic, generate leads, or remain available.

9. License You Grant to JustKansas

You retain ownership of content you submit, subject to the rights you grant us.

By submitting, uploading, posting, sending, providing, or otherwise making content available to JustKansas, you grant us a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to use, host, store, reproduce, publish, display, perform, distribute, modify, adapt, excerpt, create derivative works from, promote, and otherwise exploit that content in connection with operating, improving, marketing, and promoting JustKansas.com and related services.

This license includes the right to use submitted business names, trade names, logos, images, event information, descriptions, addresses, links, and other submitted materials in listings, search results, newsletters, social media, advertising materials, promotional placements, and related content.

You understand that submitted content may remain visible after account termination or after you request removal, including where content has been cached, archived, syndicated, backed up, shared, or incorporated into site materials.

10. Ownership of JustKansas Content

Unless otherwise stated, JustKansas.com and its design, layout, text, graphics, illustrations, logos, icons, photos, images, software, databases, directories, compilations, articles, summaries, page structure, metadata, and other materials are owned by JustKansas or its licensors and are protected by copyright, trademark, trade dress, database, unfair competition, and other laws.

You may access and use the site for personal, non-commercial, lawful purposes, or for legitimate business use expressly permitted by us. You may not copy, scrape, crawl, reproduce, republish, sell, license, distribute, frame, mirror, create derivative works from, or commercially exploit site content without our prior written permission, except where expressly permitted by law.

Unless otherwise stated in writing, all fees are due when charged and are non-refundable to the fullest extent permitted by law. You are responsible for all taxes, payment processing fees, chargebacks, and other amounts associated with your purchase.

We may suspend or terminate paid services for nonpayment, chargeback, suspected fraud, violation of these Terms, or misuse of the site.

14. Newsletter and Communications

We are not liable for outages, downtime, delays, lost data, lost submissions, display errors, broken links, indexing issues, search ranking changes, cyberattacks, technical failures, or service interruptions.

22. No Warranty

23. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the site, these Terms, or your use of JustKansas.com will not exceed the greater of:

The amount you paid us for the specific service giving rise to the claim during the three months before the claim arose; or
One hundred dollars.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

24. Indemnification

Your violation of these Terms.
Your violation of any law or regulation.
Your infringement or misappropriation of any third-party right.
Your dispute with any user, business, advertiser, event organizer, venue, customer, government agency, or other third party.

We may control the defense of any matter subject to indemnification, and you agree to cooperate with us.

25. Disputes Between Users and Third Parties

JustKansas is not responsible for disputes between users, businesses, customers, advertisers, event organizers, venues, government agencies, or other third parties.

This includes disputes about products, services, prices, payments, refunds, appointments, reservations, safety, accessibility, employment, contracts, event cancellations, business practices, intellectual property, advertising claims, reviews, or communications.

You are solely responsible for resolving your disputes with third parties.

26. Termination

We may suspend, restrict, or terminate your access to the site at any time, with or without notice, for any reason, including violation of these Terms, suspected fraud, legal risk, security concerns, infringement claims, misuse, nonpayment, or conduct we believe may harm JustKansas or others.

After termination, provisions that by their nature should survive will survive, including ownership, licenses, disclaimers, limitations of liability, indemnification, dispute resolution, governing law, and general terms.

27. Governing Law

These Terms and any dispute arising out of or relating to JustKansas.com are governed by the laws of the State of Kansas, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement below where applicable.

28. Binding Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

To the fullest extent permitted by law, you and JustKansas agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms, the site, your account, your submissions, advertising services, business listings, event listings, communications, or your relationship with JustKansas through final and binding arbitration, rather than in court.

The arbitration will be conducted by a neutral arbitrator under the rules of the American Arbitration Association or another arbitration provider agreed by the parties. The arbitration will take place in Kansas, unless the parties agree otherwise or the arbitrator allows remote proceedings.

You and JustKansas agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, private attorney general, or representative action. The arbitrator may not consolidate claims or preside over any class, collective, consolidated, or representative proceeding.

This arbitration agreement does not prevent either party from seeking relief in small claims court where permitted, seeking temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, security, or platform integrity, or contacting a government agency.

If this class action waiver is found unenforceable as to a particular claim, then that claim must proceed in court and not arbitration, unless otherwise agreed.

29. Venue for Non-Arbitrated Claims

For any claim not subject to arbitration, you agree that the exclusive venue will be the state or federal courts located in Kansas, unless a different venue is required by law.

30. Time Limit to Bring Claims

To the fullest extent permitted by law, any claim arising out of or relating to these Terms or JustKansas.com must be filed within one year after the claim arose. Otherwise, the claim is permanently barred.

31. International Users

JustKansas.com is operated from the United States and is intended primarily for users in the United States. If you access the site from outside the United States, you are responsible for complying with local laws.

32. Accessibility

We strive to make JustKansas.com useful and accessible. If you experience difficulty accessing content or features, contact us through the Contact Us form or at contact@justkansas.com with a description of the issue and the assistive technology you use, if any.

We do not guarantee that third-party websites, venues, businesses, events, maps, embeds, or linked resources are accessible.

33. Corrections and Takedown Requests

We may assign or transfer these Terms, the website, accounts, listings, content, advertising relationships, contracts, data, intellectual property, and related rights to a future business entity, successor, purchaser, affiliate, or operator without restriction.

36. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not permitted.

37. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision. Any waiver must be in writing and signed by us.

38. Entire Agreement

These Terms, together with the Privacy Policy and any additional written terms that apply to specific services, constitute the entire agreement between you and JustKansas regarding the site and supersede prior or contemporaneous agreements about the same subject.

39. Legal Notices

Legal notices may be submitted through the Legal Contact form. You are responsible for ensuring that any legal notice you send is complete, accurate, properly addressed, and sent through a working contact method.

Nothing in this section waives any requirement that formal legal process be served in the manner required by applicable law.
